Our approved trader scheme is a business to consumer service and not a business to business service. Consumer protection is our speciality and as a consumer you no longer have to take a leap of faith when you are considering a particular tradesperson to carry out home improvements. The investigations we carry out on our approved tradespeople (not businesses on the live directory) will establish the primary safety information that you the consumer need to know in order to make an informed decision: they are licensed, they are insured, they are legitimate, not bankrupt: in short, they are exactly who they claim to be.
Only home improvement tradespeople will be approved by Trading Standards. Businesses/services found on our live directory will NOT be approved by Trading Standards, will NOT be bankruptcy checked, will NOT be met face-to-face by one of our representatives and will NOT have their services directly monitored by us, instead, ratings and reviews are given by customers based on their experience.
To find approved tradespeople for home improvements you will first need to register, then it’s as simple as logging your job in your dashboard or you can log it over our support line on 0800 233 5000. If you’re not looking for home improvement tradespeople you can search our live directory where you’ll find a variety of non-home improvement services and you won’t need to register to use this service.
By using the service offered through this website, you are bound by the terms and conditions as set out below. If you do not agree to be bound by these terms and conditions, please do not use or access our service.
Consumer Terms and Conditions of use of No Rogue Traders Here
By applying to register with No Rogue Traders Here you are consenting to these Terms and Conditions and you should read these Terms and Conditions carefully before submitting your application as they will be binding upon you.
1.1. “The Application” shall mean the Application made by You for No Rogue Traders Here which you submit online to Us or over the phone.
1.2. “The Contact Telephone” shall mean the mobile or landline telephone of which you have provided the number to Us in the Application.
1.3. “The Information” shall mean such information, or documents as is provided by You to Us as requested or required in the Application or otherwise by Us.
1.4. “No Rogue Traders Here” means the system devised by Us to assist You in verifying or finding an approved Trader or Business.
1.5. “Loss” means losses, costs, damages, injuries, accidents or claims (whether direct or indirect) suffered by You in connection with Your Application and/or the use by You or on Your behalf of No Rogue Traders Here.
1.6. “Misconduct” includes failure to comply with these Terms and Conditions, attempting to obtain membership with the No Rogue Traders Here by submission of false or fraudulent information, misusing No Rogue Traders Here and misconduct in dealing with Our Staff or Traders or members of the public.
1.7. “Trader, Traders, Business, Businesses, Tradesmen, Tradespeople, Tradesperson and Sponsors” shall mean such commercial organisations or individuals whom We in Our discretion permit to use the No Rogue Traders Here system or Our facility for Voice Broadcast Alerts.
1.8. “We/Us” shall mean No Rogue Traders Here with company No: 07334384 Registered Office 162-164 High Street, Digbeth, Birmingham, B12 0LD
1.9. “You” shall mean the person who has made the Application for No Rogue Traders Here and therefore has accepted these Terms and Conditions accordingly.
2. Our Services
2.1. No Rogue Traders Here is an accessible directory of Tradespeople & Businesses who have taken up Membership of No Rogue Traders Here in accordance with our Terms and Conditions.
2.2. Before you can use our services to find home improvement tradespeople you will need to speak to one of our team in a telephone call. You will receive a call usually within 30 minutes of you registering. This call is needed for verifying your details and for security reasons. You will not be able to use your account until you have completed the call. Calls are made during office hours which are Monday to Friday between 8.30 am and 5 pm.
2.3. Our service is a members-only service and you will need to supply your name, address and telephone number and if using our online service, you will need to provide your email address. Only one account per person is permitted.
2.4. When You log a job request on our system for the services of our approved Traders/Tradespeople or Businesses, the enquiry is sent by text to the mobile phone of our approved Traders/Tradespeople and a maximum of 3 Traders/Tradespeople or Businesses can respond. As soon as Traders/Tradespeople or Businesses respond to your enquiry you will be provided with their contact details for You to make contact with them to arrange a day to be quoted. You may receive only one Tradespersons profile if the job is a small job. Our service is designed to use when you are ready to be quoted on your work.
2.5. We do not guarantee that a Trader/Business will always be available to quote you.
2.6. No Rogue Traders Here, will, once a Trader or Business has responded to your enquiry, forward onto that Trader or Business your contact details. We will forward your name, address, telephone number & e-mail. Your details are only shared with the Traders/Tradespeople or Businesses that have responded to your enquiry. If You are using our online service the onus is on You to make contact with the Traders/Tradespeople or Businesses, however, you may receive a call from the Trader/Tradespeople or Business before you make contact with them.
2.7. We do not make any warranty or guarantee as to the quality, timing, integrity, responsibility, legality, or any other aspect of the materials or services offered or delivered by any Trader which is a Member of the Directory.
2.8. We will not be a party to any contract made between you and any Trader or Business and therefore we shall not be liable for any loss or damage that results from any dealings between you and any Trader or Business including but not limited to any direct, indirect or consequential or inconsequential Loss of any kind.
2.9. When we speak to you in a telephone call, all incoming and outgoing calls are recorded.
3.0. No Rogue Traders Here has the right to update these Terms at any time. Any changes will be written here in the terms and conditions and it is, therefore, your responsibility to check the Terms and Conditions regularly for any changes.
4.1. In the event that you have a complaint in respect of work undertaken on your home, that was provided by a Trader or Business which is a Member of the Directory please refer to our complaints procedure here www.noroguetradershere.com/complaints-procedure understanding that any complaint you may have about a business that you found on our live directory will not be covered by this complaints procedure and you will have to take up the complaint with the business directly.
5. CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013
5.1 UNDER THE CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013 YOU HAVE A RIGHT TO CANCEL CERTAIN CONTRACTS FOR SERVICES WITHIN FOURTEEN (14) WORKING DAYS OF THE DAY AFTER THE DAY ON WHICH SUCH CONTRACTS ARE CONCLUDED. ADDITIONALLY, THE CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000 PROVIDE FOR A RIGHT TO CANCEL CERTAIN OTHER CONTRACTS, ALTHOUGH THIS RIGHT EXISTS FOR A SHORTER PERIOD. HOWEVER, IN BOTH CASES, THESE RIGHTS NO LONGER APPLY WHERE, AT YOUR EXPRESS REQUEST, THE SERVICE PROVIDER BEGINS TO PROVIDE THE REQUESTED SERVICE(S) BEFORE THE EXPIRY OF THE RELEVANT NOTICE PERIOD.
6. The Application
6.1. By submitting the Application to Us, You are deemed to accept these Terms and Conditions.
6.2. By submitting the Application to Us, You undertake to Us and assume contractual liability to Us for the accuracy of the Information contained in the Application and any Information supplied by You before You make the Application or subsequently.
6.3. The fact that You have submitted an Application to Us does not bind Us to accept Your Application or to enter into any Contractual Obligations with You.
6.4. By submitting the Application if You have opted to receive Voice Broadcasts Alerts You have consented to receive Voice Broadcast Alerts to the Contact Telephone.
7. Protection of Data
7.1. We are registered as a Data Processor Z2331784 under the Data Protection Act 1998.
7.2. The Data which is processed by Us in connection with an Application includes:
• Personal Data supplied by the Applicant, such as name, signature, date of birth, home address and other contact details.
7.3. The purpose for which Data may be processed by Us include:
• Validating your personal details including your mobile or landline telephone number;
• Accounting and audit, safety and security, fraud prevention and investigation, systems testing, development and maintenance;
• Customer relations, service recovery and assisting Us in future details with You;
• Marketing and market research analysis;
• Communicating to You information about No Rogue Traders Here or any other products;
• Conducting market research; and
• Any other purpose which is obvious or is communicated to You.
7.4. If You wish to have Your Data removed permanently from Our records please email email@example.com whereupon We will terminate Your Membership of No Rogue Traders Here and will take all reasonable steps as soon as practicable to remove Your Information from Our records.
8. Fees for Membership
8.1. There is no charge to use our service.
9. Voice Broadcast Alerts
9.1. We will only send Voice Broadcast Alerts to opted-in recipients.
9.2. We shall send to the Contact Telephone regular Voice Broadcast Alerts (if opted-in on Application) and Voice Broadcast Alerts will come from +448002335000
9.3. We shall only provide Voice Broadcast Alerts to You from our Sponsors & Traders and they will be handled, controlled and broadcast by Us only.
9.4. We shall use Voice Broadcast Alerts to inform you of any news and information regarding our service as well as a broad range of requirements of the type of offers about which You may wish to hear.
9.5 When receiving a Voice Broadcast Alert You can opt-out at any time by pressing 9 on your telephone keypad or by calling +448002335000 Your number will then be added to our Do Not Call (DNC) list.
9.6. We shall not charge You for Our service.
10. Your Consent
10.1. By submitting the Application to accept Voice Broadcast Alerts You have consented to receive Voice Broadcast Alerts to the Contact Telephone.
10.2. By designating the Contact Telephone You have consented to that phone being available to receive Voice Broadcast Alerts and that the Contact Telephone is in Your possession and use.
10.3. By submitting the Application You have consented to receiving such Voice Broadcast Alerts as We in Our discretion shall consider to be appropriate, except that at no time will any threatening or offensive material be included in any Voice Broadcast Alert.
11. No Warranties
11.1 It is not part of Our service to insure and We do not make any warranty as to the value, quality or suitability of any product offered by Traders & Businesses who have taken up Membership of No Rogue Traders Here or any product or service which may be mentioned or alluded to in any Voice Broadcast Alert.
11.2. Voice Broadcast Alerts will sometimes be sponsored and we assume no responsibility for any products or services offered by the company sponsoring the Voice Broadcast Alerts.
11.3. Whilst every effort is made to verify statements and information submitted by our Sponsors, No Rogue Traders Here cannot be held responsible for any omissions or inaccurate claims that may appear within any Voice Broadcast Alert.
11.4. If you decide to take up any offers offered by a company sponsoring a Voice Broadcast Alert you do so at your own risk.
11.5. We do not make any warranty as to the skill or integrity of any person or organisation from or in respect of whom or which a Voice Broadcast Alert is sent to You.
11.6. In the event that You have any complaint as to a service or product taken from a Voice Broadcast Alert You should take that complaint up with the person or organisation with whom You have dealt rather than Ourselves.
12. Regularity and Frequency of Voice Broadcast Alerts
12.1. We make no promises about how often We will send Voice Broadcast Alerts to the Contact Telephone nor as to the number of such Voice Broadcast Alerts.
12.2 Voice Broadcast Alerts will last approximately 30 to 60 seconds.
12.3. We do not charge You for this service and in Our discretion We may restrict or withdraw the service at any time.
13. SuperCover (for home improvement services only)
13.1. To qualify for SuperCover protection you must be registered with No Rogue Traders Here and have booked a home improvement job directly, either by logging into your account and registering it directly or through our support line. Then if you are not completely happy with the end result of your home improvement job and the tradesperson is refusing to work with you regarding your concerns, No Rogue Traders Here will arrange for a professional to inspect the work/service. We reserve the right to appoint a third party tradesperson taken from our list of approved tradespeople to provide an independent opinion to inform our decision-making process. We will mediate with the support of Trading Standards to help resolve any issues. We will decide whether the complaint is justified or not and if the complaint is upheld the tradesperson will be asked to complete the work to your satisfaction, if the tradesperson refuses his membership will be terminated. Once a complaint has been made, No Rogue Traders Here reserves the right to put the consumers membership on hold until the dispute has been resolved. SuperCover protection does not cover any financial losses you may incur and is not a guarantee of any work completed or service undertaken. SuperCover protection is not provided when choosing businesses from our live directory of non-home improvement services. Your statutory rights are not affected.
14. Our Obligations
14.1. Upon receipt of appropriate and accurate Information from You We shall provide You with use of the No Rogue Traders Here system.
14.2. Subject as above, We will take reasonable care, in accordance with Our Obligations as a Data Processor, to protect Your Information and Data.
15. Your Obligations
15.1. You undertake to Us and warrant with Us so as to create a contractual liability to Us that all and any Information supplied by You to Us, whether in the Application or otherwise, is complete and accurate.
15.2. You acknowledge that the Contract between us is one of utmost good faith; that is to say, if You consider that You have Information which might affect Our decision as to whether or not to accept the Application by You, You will provide that Information to Us forthwith that You become aware of it.
15.3. You also undertake and warrant with Us so as to create a contractual liability to Us that You will provide full details of any change in Your address or other Information supplied by You to Us immediately.
15.4. Use of the Website Services is at your own risk. The Website Services are presented on an “AS IS” AND “AS AVAILABLE” basis excluding any representation or approval made and devoid of guarantee of any kind either express or implied, together with but not limited to the implied warranties of acceptable quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
16. Advertising and Publicity Material
16.1. In Our discretion We may provide advertising or publicity material to You.
16.2. You acknowledge that any advertising or publicity material supplied to You may not be used by You or passed on to any third parties without Our consent.
17. Intellectual Property
17.1. The website and its contents and the intellectual property therein is in our ownership.
17.2. By accessing the website, you confirm that your use will be purely for individual, non-commercial use.
17.3. None of the content of the website can be copied or re-produced without our prior approval in writing.
18. Use of Information
18.1. The information in the Directory is for You only and cannot be shared with the general public and the Traders who are Members have consented to the disclosure of it to You only.
18.2. If You provide information to us, the provision of such information shall be taken as your consent that we may disclose such information as we see fit including disclosure to Traders who are Members of the Directory.
18.3. You acknowledge and contract that You will not use or copy the No Rogue Traders Here system or any material, publicity or information connected with it without Our express consent in writing.
18.4. You acknowledge and contract that You will not pass on to the general public the contact details of Traders who are Members of the Directory without Our express consent in writing.
18.5. You acknowledge and contract that You will register any subsequent work required from Traders who are Members of the Directory either on the No Rogue Traders Here website or in a telephone call to our support line.
19. Extent of Our Liabilities
19.1. In the case of any breach or alleged breach by Us to You of our Obligations to You under the Contractual relations between us, the extent of Our Liability shall in any event be limited to the amount of the annual Membership Fee last paid by You.
19.2. We shall not in any event be liable for any consequential losses to You in respect of any breach by Us.
19.3. We make no guarantee that the Website Services will meet your needs, that content will be correct or reliable, that the site’s functionality services will be continuous or error free, that defects will be corrected or that the site services or the server that makes it available are free of viruses or additional things that may be potentially harmful or damaging.
19.4. We do not accept any liability for any error which may be encountered for reasons beyond Our control in Your using the No Rogue Traders Here system, either when making a purchase, dealing with a Trader or otherwise.
20. Limitation of Liability
20.1. In the event that We do not accept Your Application, there will be no Contract between us and We will have no liability for any Loss arising.
20.2. We will not be liable for any Loss if, by reason of local or regulatory prohibitions or restrictions, You are unable to use the No Rogue Traders Here system.
20.3. Our liability for negligence, breach of Contract or any other matter is limited to reimbursing any sums paid by You for the No Rogue Traders Here system.
20.4. Nothing in this agreement can be construed as to exclude or limit the liability of No Rogue Traders Here for death or injury to people resulting from No Rogue Traders Here negligence.
20.5. No Rogue Traders Here disclaims any liability whatsoever for any damage, lawsuits, claims, or any other controversies that have arisen or may arise, whether known or unknown from any advice, instruction or service delivered by a professional that originated from this website.
21. Termination of service
21.1 Our Agreement starts when you register for a No Rogue Traders Here account. We will continue to provide the Services until you or we end this Agreement. In any event, you can end the Agreement at any time by telling us to close your account either by logging in or calling us on 0800 233 5000. We may suspend some or all of the Services or end this Agreement at any time where:
• You’ve misused the Service or are abusive to our staff;
• We’ve got reasonable grounds to suspect fraud in relation to your Account;
• You haven’t provided us information we have reasonably requested;
• You’re no longer eligible for the Services, e.g. because you’re no longer resident in the UK;
• You no longer appear to be using the Services.
21.2 You agree that No Rogue Traders Here, in its sole discretion, has the right (but not the obligation) to deactivate your account, block your email address, or otherwise terminate or restrict your access to or use of the website, immediately and without notice, for any reason, including, without limitation, if No Rogue Traders Here believes that you have acted inconsistently with the letter or spirit of the terms.
21.3 You agree that No Rogue Traders Here shall not be liable to you or any third-party for any termination or restriction of your access to the website. Further, you agree not to attempt to use the website after said termination.
22. Entire Agreement
22.1. The provisions of these Terms and Conditions, together with the duly completed Application by You and Our acceptance of it, shall constitute the entire Contract between Us and You.
22.2. You accept and understand that You have not placed reliance upon any representations or statements, whether pre-contractual or otherwise, made by Us or on Our behalf, nor has any Side Agreement been entered into in respect of the Contract between You and Us.
23. Force Majeure
23.1. You understand and acknowledge that in the case of any circumstances beyond Our control which may make it impossible, or limit Our ability, to maintain the No Rogue Traders Here system, We shall not be liable to You for any losses in relation to the same.
23.2. You further acknowledge that in the case of any legal issues arising which may prevent or limit Our ability to provide the No Rogue Traders Here system or to maintain Your Membership of it, We shall not be liable for any liability arising to You as a result.
24. Jurisdiction and Governing Law
24.1 It is agreed that in any case the Courts of England and Wales shall have Jurisdiction in respect of any matters arising between You and Us and the Governing Law in each case shall be the Law of England and Wales.
